General Terms of Service
This is my basic TOS. Some of my VGen commissions have slight variations depending on the commission so please always ready through them. I understand these can be overwhelming but do remember that these are here to protect you as a client and me as an artist. If you ever have any questions, please reach out on any of my linked social media.
GENERAL
Please provide visual references of any original characters, environments, or backgrounds. I will not work off text-heavy descriptions alone unless you are paying specifically for design work, which I may or may not be offering at the current opening.
Please describe how you want your artwork to be. The posing, expressions, outfit, lighting, and how the overall look looks in your mind. Sending visual references will help me understand what you want more clearly, which will be alongside text descriptions and directions.
If you're unable to find a reference photo, Do not be shy to also send stick-man figures or a simple doodle to help me work towards your intended goal.
I reserve the right to refuse any commission. A refund will be issued in this case.
The process I will be following is going to be a queue list. This means It will be in the order of clients that have reached out & made a payment first, ending with the most recent client's commission received.
Payments
No commission will be started until they are paid for. Base prices are subject to change based on the complexity of the request, this will be negotiated with the client.
REVISIONS
Revisions during the sketch phase are free of cost, regardless of how small or big. This stage is crucial to reaching your satisfactory goal. Please mind that honesty is very important during revisions, if you are unhappy with anything, let me know so I'm able to correct it as fast as possible.
After the final sketch phase approval, revisions get harder but are still possible. Communication is the key to hopefully making both parties satisfied.
Small revisions are free of cost; such as color corrections, changing an expression, or other similar simple tasks. However, Please note that frequent revision requests will be charged, so please be mindful and honest as soon as possible, while mentioning everything you deem in need of change.
Major revisions such as pose changes, changes in composition or character outfit/design, etc. past the stage of the final sketch will incur additional fees depending on how drastic the changes are.
Please note that revisions exclude requests for a change of art style other than mine is prohibited. You are fully responsible for picking me as your artist and the style of my work.
Skeb-style commissions are not subject to revisions in most instances. The only times this is allowed is a major mistake on my part as the artist (i.e. incorrect race or gender).
DEADLINES AND DELIVERY
The time of art commission completion will be between a week to 3 months, which highly depends on the art style chosen and the complexity of the piece complexity. However, please mind that your turn in the queue isn't a factor in this.
Short deadlines will have to be negotiated prior to anything. A fee may be included depending on the date and how long the art style chosen often takes.
You may ask for a status update on the established channels of communication. Please do not rush me if my estimated time is not nearing its end yet, and kindly do not expect me to finish the day after you have ordered a commission.
The finished artwork will be sent via established channels when the commission is completed.
USE & INTELLECTUAL PROPERTY RIGHTS
All artwork is for personal use only unless agreed otherwise or a commercial license is purchased. Personal use includes streaming & content use, sharing the work on social media/using it as a wallpaper/icon with credit, the right to print and hang it on your wall or gift it to a friend, etc. If art is used as a model for streaming, you must have a way to credit me for the model (Twitch panels, YouTube descriptions, etc.)
Client retains all rights to their character(s) I retain the right to post the commissioned artwork's final product and/or work in progress on my website or social media, which is considered a means of marketing for me as the artist.
A request to keep the commissioned artwork private and/or remain unposted by the artist will include a fee.
In the case of a canceled character design commission (i.e. unpaid for), I reserve the right to keep the character design. In plain terms, if you commission me to design you a character and you fail to pay for it or cancel the commission; the design will be my property until it is paid for.
Training and processing the artwork through any AI training and generative site/device is strictly prohibited. Reproducing a commission for any blockchain-related reasons, including NFTs, is also prohibited.
COMMERCIAL LICENSE
A commercial license starts at +100% of the price of the commission or set price depending on the commission. This means the client has the rights to reproduce and use the artwork for commercial use such as merchandise, ads, and prints. Anything that would net you, the client, a profit from the artwork. This license also includes the ability to not need to credit for the work.
REFUNDS
I DO NOT accept refunds or cancellations, once the commission has gone past the sketching/revision phase you have agreed that you are happy with it and the work is to be finished.
The ONLY exception is when I cancel a commission. I reserve the right to cancel any commission. If I cancel, a full refund will be given regardless of my progress on the piece.
COMMUNICATION
Please provide a way to DM you directly (Kofi, Bluesky, Twitter/X, Discord, Instagram, etc)
After I accept your request I will reach out to you via the provided channels to confirm my start on your commission and for any questions from me or you.
Feel free to reach out to me with any questions or concerns. You are expected to be polite and professional during communications. Abusive behavior will result in termination of your commission and it will be delivered in its current state regardless of stage of completion.
If an unforeseen event occurs that could delay or prevent the completion of your art piece, you'll be contacted and informed about it as soon as I find the ability to do so.
By commissioning me, you understand and agree to the terms and conditions. Any breach will result in immediate termination of your request, no refund will be allowed and no legal action will be taken.
